Protective Structures for earthmoving equipment…

Hi all,

I work as WHSE Manager for an earthmoving and heavy haulage company that works in both ACT and NSW.

We have received a generic e-mail about Falling Objects Protective Structures (FOPS) and Roll Over Protective Structures (ROPS) for earthmoving equipment, reminding that there is a requirement on PCBUs to ensure that all earthmoving equipment has a Protective Structure in place prior to use. It seems that there is no transitional arrangements I the ACT however in NSW there is a 12 month transitional arrangement in place for certain items of plant.

We seem to be a bit confused with this ROPS / FOPS situation. Can anyone advise us on what types of machines need ROPS / FOPS (Bulldozers, Graders, Excavators, Rollers, Scrapers, Backhoes etc) Most of our machines have a ROPS cab.  Will they need to be certified?  Do they also need to have FOPS fitted?

Any thoughts, advice or suggestions would be much appreciated.

Hi Ron,

ACT have come out and said that they will follow NSW with the 12 month transitional period in regards to the protective structures on earthmoving machinery. As for what machines need the protective structure (ROPS / FOPS) as stated in section 217 it is all earthmoving machinery with a weight over 1500kg. And by the sounds of it they want ROPS & FOPS fitted as per section 214 Powered mobile plant general control of risk - the Person with management or control of powered mobile plant at a workplace must in accordance with part 3.1 manage risks to health and safety associated with the following: (a) the plant overturning (ROPS / TOPS), (b) things falling on the operator of the plant (FOPS) and from my understanding they will need to be certified with a plate fitted to the cab.
